General Terms and Conditions
Introductory Provisions

These terms and conditions apply to purchases in the online store casaalmeida.cz. They define and specify the rights and obligations of the seller and the buyer (customer).
In the case of a purchase agreement concluded using remote communication means and goods delivered via shipping service, courier, or picked up at the Palachova branch, the seller is Antonio Cesar Almeida de Souza Junior, registered at Palachova 251/8 Ústí nad Labem, Company ID: 21259259, registered in the Commercial Register maintained by the Municipal Court in Ústí nad Labem (“Casa Almeida” or “Seller”). Definitions

1. Consumer contract – purchase contract, contract for work, or other contracts under the Civil Code, where one party is the consumer and the other is a business or seller. Casa Almeida hereby notifies consumers that purchase-consumer contracts can only be concluded in the Czech language.
2. Seller – a person who acts within their business or professional activity when concluding and fulfilling a contract. It is a business entity that directly or through other businesses delivers goods or provides services to the buyer.
3. Buyer/Consumer – a person who does not act within their business or professional activity when concluding or fulfilling the contract, or a natural person who purchases goods or uses services for purposes other than business.
4. Buyer who is not a consumer – an entrepreneur who buys goods or uses services and provides their Company ID (IČ) to the seller and will act under that ID.
5. Terms and Conditions – these business terms of Casa Almeida, which you receive in the confirmation email after placing an order, are available at our physical branches and on our website. You must explicitly agree to these terms before concluding a purchase contract. They are also included in the order form.

Order and Conclusion of the Purchase Contract

1. By placing an offer to sell goods on the website, the seller expresses the intention to conclude a purchase contract under the stated conditions.
2. Steps to conclude a purchase contract:

a) The buyer (consumer) selects goods, clicks “buy” to add items to the cart;
b) Then clicks “add to cart”, which opens a new tab displaying the cart with all items – a summary of selected goods;
c) Then selects shipping and payment methods from the available options;
d) As a penultimate step, enters contact details;
e) Clicking “summary” shows a recap of all information entered;
f) The contract is concluded when the buyer confirms the order by clicking the “Order and Pay” button, creating a payment obligation;
g) From this moment, mutual rights and obligations arise from the contract. For the buyer, this means especially the obligation to pay the price;
h) Until the final confirmation of the order, the buyer can return to previous steps and correct errors. After confirmation, corrections follow the rules in paragraph 3 below.

3. Orders can be canceled using contact information provided on the website: +420 602 382 719 or info@casaalmeida.cz. These can also be used to update order details.
4. Contracts are concluded in Czech. If both parties agree, another mutually understandable language may be used. The contract (order) is archived and is not accessible to third parties. Technical steps to conclude the contract are visible during the ordering process at www.casaalmeida.cz, and the buyer can review and correct it before submission.
5. Costs of using remote communication means (phone, internet) are standard according to your service provider.
6. By submitting the order, the buyer confirms having read and agreed to these terms and the complaint procedure. They are clearly accessible before order confirmation.
7. An electronic order is valid only if all mandatory fields are completed.
8. By completing the registration or order form on www.casaalmeida.cz, the buyer consents to the collection and processing of personal data and purchase history (see the “Privacy” section).
9. The contract will be stored with the seller, and the buyer may request access.

Prices and Purchase Conditions

1. The buyer receives goods at the price valid at the time of ordering, as listed on our website.
2. The buyer is informed in advance of the total price including VAT and other charges. A recycling fee may be added as per legal requirements.
3. Shipping fees are listed in the online order form.
4. Product prices are rounded to the nearest crown. A detailed breakdown including cents is shown in the cart.
5. Packaging is included. It means safe wrapping for fragile items, sealing with tamper-evident tape, serial number tracking, etc.
6. Delivery address is as specified in the order.
8. Upon delivery, the buyer receives a delivery note, which also serves as a warranty certificate unless a manufacturer’s warranty is provided.
9. These terms are displayed on the website and sent by email.

Complaints

1. Complaints will be handled according to the complaints policy and Czech law.
2. Goods can be claimed at authorized service centers.
3. Claims can also be made via info@casaalmeida.cz.

Photos and Colors

It is difficult to accurately reproduce the shades of ceramic glaze under artificial light. We have made every effort to ensure accurate descriptions and color representation. We are not responsible for differences due to browser, phone, or computer settings. Most items are handmade, so each piece may vary slightly. Images are indicative representations.

Right of Withdrawal within 14 Days for Distance Contracts

1. A consumer may withdraw from the contract within 14 days of receiving the goods without giving any reason, under § 1829 et seq. of the Civil Code. Goods must be returned within 14 days of withdrawal notice. The refund will be processed within 14 days after goods are received or proof of return is given, via the same payment method.
2. If the buyer selected a more expensive delivery method, only the cost of the cheapest method will be refunded.
3. Withdrawal must be done via written notice (email, post).
4. The buyer bears the return shipping costs.
5. No withdrawal is allowed under § 1837 of the Civil Code for:
– Services already performed with consent;
– Goods customized or perishable;
– Sealed goods unsealed for hygiene reasons;
– Audio/video/software with broken seals;
– Newspapers or magazines;
– Digital content delivered without physical medium and with prior consent.

Seller’s Rights and Obligations

1. The seller must fulfill the order within 30 days unless otherwise agreed.
2. All personal data is confidential.
3. On request, the seller must delete the buyer’s data.
4. The seller may withdraw from the contract if fulfillment is impossible.
6. If payment was made in advance, and the order is canceled, a full refund must be issued within 5 days.

Buyer’s Rights and Obligations

1. Provide accurate delivery/billing addresses.
2. Accept delivery and pay the agreed total price.
3. If the goods differ from the contract, the buyer has the right to a replacement, repair, discount, or withdrawal.
4. Buyers may request deletion of personal data in writing.
5. For in-person pickup with prepayment, ID is required.
6. For payments over 20,000 CZK, ID is required; authorization is needed if another person picks it up.
7. Consumers may use ADR via https://www.coi.cz/informace-o-adr/ or the EU ODR platform: https://ec.europa.eu/consumers/odr.
8. Reviews on the website are from verified customers only, via a unique email code after purchase.

Final Provisions

1. The version of terms valid on the date of the electronic order submission applies.
2. By submitting the order, the buyer accepts all applicable terms, including prices, unless otherwise agreed.
